Who we are. These terms apply between Dr Luella Forbes, trading as The Narratologist PTY LTD, ABN 16 673 215 980 ("I"), and the person or organisation enrolling or booking ("you"). They apply to each program, course, mentoring package and session I offer (each a "service"). You accept these terms by ticking the box on the enrol or booking form, by paying, or by asking me to proceed.
The service. The inclusions, format, dates, service period, access period and fees of your service are those on the landing page or brochure for that service at the time you enrol or book, and in your confirmation email.
My obligations. I will deliver the service with due care and skill, in a professional and timely manner, and in line with relevant laws.
Your obligations. You will give me the information I ask for promptly. I may rely on it without checking it. For in-person sessions, you will provide a safe location that meets work health and safety requirements.
Fees and payment. Fees are in Australian dollars. GST of 10% is added to fees shown as ex GST. Payment is by card through Stripe, or by invoice where I have agreed this in writing. Amounts unpaid 7 days after the due date may attract interest at 10% a year, and I may suspend the service until payment is received. If you do not pay, you agree to pay my reasonable costs of recovering the debt. The fee you pay is the fee shown when you enrol or book. Fees for new enrolments may change.
Instalments. Where a service offers instalments and you choose that option, you agree to every instalment. Each later instalment is taken automatically from the card you used for the first. If an instalment fails, it is retried after 7 days. If it is still unpaid, your access is paused until payment is received.
Sessions and scheduling. Sessions are held online on Teams, or in person where the landing page, brochure or confirmation says so. Where a session is held on a date I publish and you cannot attend, you are booked into the next one. Sessions not used within your service period lapse. I may change session dates or formats where needed. I will tell you as early as possible and offer a reasonable alternative.
Access and materials. Your login to any online site or vault is for your personal use only. Do not share your login or any material with others.
Conduct and your confidentiality. You agree to take part respectfully, to keep confidential what other participants and I share in sessions, and not to record, screenshot or redistribute sessions or materials.
My confidentiality. I keep confidential any information and documents you provide to me for the program, course or session you have signed up for, before, during or after it. I use them only to prepare for and deliver the service, and do not disclose them to anyone else unless required by law. I handle personal information in line with my Privacy Policy.
Intellectual property. All content I provide, and any intellectual property created in delivering the service, remains mine. I grant you a non-exclusive, non-transferable licence to use it in your own professional practice, once you have paid. You may not resell, republish or teach it as your own. If you reproduce it, you must credit me as the author.
Limits of the service. The service is for your use only. I am not a lawyer, accountant or licensed financial adviser. Before you act on my advice, consider whether it suits your circumstances and get any legal, financial, tax or other professional advice you need. To the extent the law allows, I give no warranties other than those in these terms, I am not liable for indirect or consequential loss or loss of profit, and my total liability is limited to re-performing the service or refunding the fee you paid. Nothing in these terms limits rights you have under the Australian Consumer Law.
Cancelling or rescheduling. If you cancel or reschedule 14 or more days before the session, you receive a full refund, or a reschedule at no charge. If you cancel or reschedule 7 to 13 days before, you receive a 50% refund, or one reschedule at no charge. If you cancel or reschedule less than 7 days before, there is no refund, and I may offer one reschedule at my discretion. If I need to reschedule, you choose a new date or receive a full refund. Fees for programs and courses are not refundable once you have enrolled, except where required by law.
Ending the service. I may end your access if you breach these terms and do not fix it within 7 days of my written notice. I do not refund fees in that case, except where required by law.
Transfer. A place cannot be transferred to another person.
Privacy. I collect your name, contact details, organisation, role, address and any answers you give in forms, to deliver the service and to post materials. I store them in HighLevel and use them only for the service and for communications you have agreed to. Read my Privacy Policy.
Disputes. If a dispute arises, we will first try to resolve it by negotiation. If we cannot resolve it within 30 days, it goes to mediation under the Resolution Institute Rules for Mediation. Each of us bears our own costs, and we share the mediator's costs equally. This does not stop either of us seeking urgent injunctive relief, or me recovering unpaid fees through the courts.
General. The laws of Western Australia govern these terms, and we submit to the non-exclusive jurisdiction of the courts of Western Australia. These terms and your confirmation email are the whole agreement for the service. They can only be changed by written agreement, including by email. Nothing creates an employment, agency, partnership or joint venture relationship between us. A waiver of one breach does not waive a later breach. If part of these terms is invalid, the rest stays in force. You may not assign your rights without my written consent.
